Terms of Service

1. Agreement to Terms

By accessing or using the website located at chance.party (the “Site”), purchasing tickets, or attending any event organized by CHANCE (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Site or purchase tickets.

We reserve the right to modify these Terms at any time. Changes become effective when posted to the Site. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 16 years of age to purchase tickets or attend CHANCE events unless otherwise specified for a particular event. By purchasing a ticket, you represent and warrant that you meet the minimum age requirement for the specific event.

If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to agree to these Terms, purchase tickets, and attend the event.

3. Ticket Purchases

3.1 Guest Checkout

The Site operates on a guest checkout model. No account creation is required to purchase tickets. You will be asked to provide your name, email address, and phone number to complete a purchase. This information is used to deliver your tickets and communicate event-related information.

3.2 Pricing and Availability

All ticket prices are displayed in United States Dollars (USD) and include applicable fees. Ticket availability and pricing are subject to change without notice. Prices may vary based on sale phase (presale, general sale) and ticket type (student, non-student). Student-priced tickets require a valid student ID to be presented at the door.

3.3 Reservations

When you begin the checkout process, tickets are temporarily reserved for a period of 10 minutes. If you do not complete your purchase within this time, the reservation expires and the tickets are released for other buyers. Reservations are limited to one active reservation per IP address.

3.4 Payment Processing

All payments are processed securely through Stripe, Inc. (“Stripe”), a PCI-DSS Level 1 certified payment processor. We do not store, process, or have access to your full credit card number, debit card number, or bank account information. By completing a purchase, you also agree to Stripe's Terms of Service and Privacy Policy.

3.5 Order Confirmation

Upon successful payment, you will receive an order confirmation email at the email address provided during checkout. This email will contain your QR code ticket(s). Each ticket has a unique QR code that serves as your entry credential. It is your responsibility to ensure you can present your QR code (digital or printed) at the event.

3.6 Purchase Limits

Ticket purchases are limited to a maximum of 4 tickets per order. We reserve the right to cancel orders that exceed this limit or that we reasonably believe are made for the purpose of resale.

4. Refund and Cancellation Policy

All ticket sales are final. No refunds, exchanges, or credits will be issued except in the following circumstances:

  • The event is cancelled by CHANCE and not rescheduled.
  • A duplicate charge occurs due to a technical error (verified by our payment records).

If an event is rescheduled, your tickets will be valid for the new date. If you cannot attend the rescheduled date, you may request a refund within 7 days of the rescheduling announcement by contacting us at chance.live.events@gmail.com.

If an event is cancelled, refunds will be processed to the original payment method within 10 business days.

5. Event Attendance

5.1 Entry Requirements

You must present a valid QR code ticket for entry. Each QR code may only be scanned once. If you purchased a student-priced ticket, you must present a valid student ID at the door. Failure to present a valid student ID may result in denial of entry or requirement to pay the difference to the non-student price.

5.2 Code of Conduct

By attending a CHANCE event, you agree to comply with all venue rules and applicable laws. We reserve the right to refuse entry to or remove any attendee from an event without refund for any reason, including but not limited to: disruptive or dangerous behavior, intoxication, possession of prohibited items, violation of venue policies, or failure to meet age requirements.

5.3 Assumption of Risk

Attendance at CHANCE events is at your own risk. Events may include loud music, strobe lighting, fog/haze effects, and crowded conditions. You voluntarily assume all risks associated with attending the event, including but not limited to hearing damage, physical injury, or exposure to communicable diseases.

5.4 Media Release

By attending a CHANCE event, you consent to the use of your likeness in photographs, video recordings, and other media captured at the event. These materials may be used by CHANCE for promotional, marketing, or editorial purposes without compensation to you.

6. Prohibited Activities

You agree not to:

  • Resell, transfer for profit, or scalp tickets purchased through the Site.
  • Use automated systems, bots, or scripts to purchase tickets.
  • Circumvent or attempt to circumvent any purchase limits or security measures.
  • Reproduce, counterfeit, or tamper with QR code tickets.
  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Interfere with or disrupt the Site, servers, or networks connected to the Site.

7. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, audio, video, software, and the overall design and layout, is the property of CHANCE or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

The CHANCE name, logo, and all related marks are trademarks of CHANCE. You may not use any of our trademarks without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CHANCE, its owners, operators, affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from:

  • Your use or inability to use the Site or attend an event.
  • Any unauthorized access to or alteration of your personal information.
  • Any interruption or cessation of transmission to or from the Site.
  • Any bugs, viruses, or similar issues transmitted through the Site.
  • Any errors, inaccuracies, or omissions in any content on the Site.

In no event shall our total liability to you for all claims exceed the amount you paid for your ticket(s).

9. Indemnification

You agree to indemnify, defend, and hold harmless CHANCE, its owners, operators, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your attendance at any event, your violation of these Terms, or your violation of any rights of another party.

10. Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Denver County, Colorado. You consent to the personal jurisdiction and venue of such courts.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CHANCE regarding your use of the Site and purchase of tickets, and supersede all prior agreements, representations, and understandings.
