Terms of Service

1. Agreement to Terms; Electronic Acceptance

These Terms of Service (these “Terms”) are a binding legal agreement between you and CHANCE, an event production operation based in Denver, Colorado (“CHANCE,” “we,” “us,” or “our”). These Terms govern (a) your access to and use of the website located at chance.party, including all subpages, checkout flows, and ticket-management tools (collectively, the “Site”); (b) your purchase, receipt, transfer, or use of any ticket issued through the Site (a “Ticket”); and (c) your attendance at any event organized, promoted, or produced by CHANCE (an “Event”).

By using the Site, purchasing a Ticket, accepting a transferred or complimentary Ticket, or attending an Event, you accept and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Site, purchase Tickets, or attend an Event.

Electronic acceptance.During checkout, you are shown a notice that continuing constitutes agreement to these Terms before you can proceed to payment. You agree that clicking “Continue to Payment” (or any similarly labeled control accompanied by that notice) constitutes your electronic signature and your acceptance of these Terms, with the same legal effect as a handwritten signature, consistent with the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN) and the Colorado Uniform Electronic Transactions Act. For each completed order we create and retain a record of acceptance, including the date and time of acceptance, the version number of the Terms accepted, the IP address from which the order was placed, and the browser/device identification string of the purchaser. You agree that these records are admissible evidence of your agreement to these Terms.

Versioning. Each published revision of these Terms carries a version identifier (displayed at the top of this page). The version in effect at the time you complete a purchase governs that purchase and the associated Event attendance. We may modify these Terms prospectively at any time by posting a revised version to the Site; revisions apply to purchases made after posting.

2. Operator and Contact

The Site and Events are operated by CHANCE, Denver, Colorado. For all legal notices, questions, refund requests, and privacy requests, contact: chance.live.events@gmail.com. Notices to you will be sent to the email address you provide at checkout, and you are responsible for keeping that address current and monitoring it.

3. Eligibility, Age Requirements, and Minors

3.1 Minimum Age

Each Event has a posted minimum age (for example, 16+, 17+, 18+, or 21+), displayed on the Event page and during checkout. You must meet the posted minimum age for the specific Event on the date of the Event to attend. By purchasing a Ticket, you represent and warrant that each person who will use a Ticket from your order meets the posted minimum age. We reserve the right to verify age with government-issued or school-issued photo identification at the door and to refuse entry, without refund, to any person who cannot demonstrate that they meet the posted minimum age.

3.2 Purchasers and Attendees Under 18

If you are under 18 years of age (a “Minor”), you may only purchase a Ticket and attend an Event with the knowledge and consent of your parent or legal guardian. By completing a purchase as a Minor, you represent and warrant that your parent or legal guardian (a) has reviewed these Terms, including the assumption of risk, release of liability, and media provisions; (b) consents to your purchase and attendance; and (c) agrees to be bound by these Terms on your behalf and on their own behalf.

If you are a parent or legal guardian who purchases Tickets for, consents to the attendance of, or permits the attendance of a Minor, then you agree to these Terms both individually and on behalf of that Minor, and you make the release and waiver in Section 12 on the Minor’s behalf as permitted by Colorado Revised Statutes § 13-22-107, which authorizes a parent to release prospective negligence claims of a minor child. You further agree that you are responsible for the Minor’s compliance with these Terms and all venue rules while at the Event.

3.3 Accuracy of Information

You agree to provide true, accurate, and complete information during checkout, including your legal name, a working email address, and (if provided) a working phone number. We may cancel any order placed with false, misleading, or incomplete information.

4. Ticket Purchases

4.1 Guest Checkout

The Site operates on a guest checkout model; no account creation is required. You will be asked to provide your first and last name, email address, and optionally a phone number to complete a purchase. This information is used to deliver your Tickets, operate the Event, and communicate Event-related information, as described in our Privacy Policy.

4.2 Pricing, Sale Phases, and Availability

All prices are stated in United States Dollars. Ticket availability, ticket types, and pricing vary by sale phase and may change at any time without notice; the price displayed in your checkout summary at the time of payment is the price you will be charged. Certain discounted ticket types (for example, student or senior-class pricing) are conditioned on eligibility and may require presentation of valid identification at the door; if eligibility cannot be verified, entry may be refused or the price difference to the standard ticket may be collected at the door.

4.3 Reservations

When you begin checkout, the selected tickets are held for you for 10 minutes. If payment is not completed within the hold window, the hold expires and the tickets are released for sale to others. A hold is not a completed purchase and confers no rights.

4.4 Payment Processing

All payments are processed by Stripe, Inc. (“Stripe”), a PCI-DSS Level 1 certified payment processor. We do not receive or store your full payment card details. By completing a purchase you also agree to Stripe’s applicable consumer terms and privacy policy, available from Stripe. A purchase is complete only when payment is confirmed by Stripe and an order confirmation is issued.

4.5 Order Confirmation and QR Code Tickets

Upon successful payment, an order confirmation containing your QR code Ticket(s) is sent to the email address provided at checkout. Each Ticket carries a unique QR code that serves as the entry credential and is valid for one entry only. You are responsible for (a) providing a correct email address, (b) safeguarding your QR codes, and (c) presenting a scannable QR code (on a device or printed) at the door. Treat your QR code like cash: anyone presenting it first will be admitted, and we are not obligated to admit a second presenter of the same code.

4.6 Purchase Limits; Cancellation Rights

Purchases are limited to 4 tickets per order. We reserve the right to cancel, with a refund of the amount paid, any order or Ticket that we reasonably believe (i) exceeds or evades purchase limits, (ii) was placed by an automated system, (iii) was placed for the purpose of unauthorized resale, or (iv) was procured by fraud or in violation of these Terms.

5. Refund and Cancellation Policy

All Ticket sales are final. Except as expressly stated in this Section 5 or where required by applicable law, no refunds, exchanges, or credits will be issued for any reason, including your inability to attend, dissatisfaction with the Event, denial of entry or removal for violation of these Terms or venue rules, changes to the advertised lineup or set times, or lost, deleted, or inaccessible confirmation emails.

• Cancellation. If an Event is cancelled and not rescheduled, we will refund the face amount you paid for your Tickets to the original payment method within 10 business days of the cancellation announcement.
• Rescheduling. If an Event is rescheduled, your Tickets remain valid for the new date. If you cannot attend the rescheduled date, you may request a refund within 7 days of the rescheduling announcement by emailing chance.live.events@gmail.com; timely requests will be refunded to the original payment method within 10 business days.
• Duplicate charges. Verified duplicate charges caused by a technical error will be refunded.

Changes to the performing lineup, supporting acts, set times, or production elements do not constitute a cancellation and do not entitle you to a refund. Refunds are limited to the amount actually paid for the Ticket; we are not responsible for other expenses you incur in connection with an Event (such as travel or lodging).

Chargebacks. If you believe a charge is incorrect, contact us first at chance.live.events@gmail.com. Initiating a payment dispute for a valid, delivered order may result in cancellation of the associated Tickets and refusal of entry.

6. Ticket Transfers

The Site provides an official transfer tool that lets a purchaser send an individual Ticket to a named recipient by email. Transfers are permitted only through this official tool. When a transfer is accepted, the recipient receives a new QR code and the sender’s prior QR code for that Ticket is permanently invalidated. A recipient who accepts a transferred Ticket accepts these Terms.

• A Ticket with a pending transfer is temporarily locked: it will not scan for entry until the transfer is accepted or cancelled.
• New transfers cannot be initiated after doors open for the Event. Pending transfers not accepted within 2 hours after doors open expire automatically.
• We are not a party to any arrangement between a sender and a recipient and are not responsible for disputes between them, other than honoring the transfer state recorded in our system.

7. Resale Prohibition and Ticket Integrity

Tickets are revocable licenses for one-time entry to the Event, are not property interests, and may not be resold for profit, offered as a prize or promotion, or used for any commercial purpose without our prior written consent. You may not reproduce, duplicate, counterfeit, alter, or tamper with any Ticket or QR code. We reserve the right to void, without refund, any Ticket that we reasonably determine has been obtained or used in violation of this Section, and to refuse entry to any person presenting such a Ticket.

8. Entry Requirements and Security Screening

Admission requires a valid, scannable QR code Ticket and compliance with all entry conditions posted at the venue or on the Event page. As conditions of entry, you consent to:

• Verification of your age and identity by photo ID where required (including for age-restricted admission and discounted ticket types).
• Reasonable search of your person and belongings, including bag checks, pat-downs, and metal-detector or wand screening, conducted by Event or venue security. Refusal of screening is grounds for denial of entry without refund.
• Confiscation of prohibited items, which will not be returned or stored.
• The venue’s posted re-entry policy. Unless otherwise posted, exit from the venue ends the admission granted by your Ticket.

Doors close and last entry may be enforced at posted times. Arrival after last entry is not grounds for a refund.

9. Prohibited Items

Unless expressly permitted in writing by CHANCE or the venue, the following may not be brought into any Event:

• Weapons of any kind, including firearms, knives, pepper spray, and tasers, regardless of permit.
• Illegal drugs, controlled substances, and drug paraphernalia.
• Alcohol of any kind brought from outside the venue.
• Vaporizers, e-cigarettes, and tobacco products, where the attendee is under the legal age or where posted rules prohibit them.
• Outside food or beverages, glass containers, and open liquid containers.
• Fireworks, flares, laser pointers, and aerosols.
• Professional recording equipment (detachable-lens cameras, audio recorders, video rigs, drones) without prior written authorization.
• Backpacks or bags larger than the size posted at the venue entrance.
• Any other item that Event or venue security reasonably deems a safety risk.

10. Code of Conduct; Substance Policy; Removal

You agree to comply with these Terms, all posted venue rules, all instructions of Event and venue staff and security, and all applicable laws while attending an Event. Unless the Event page expressly states otherwise, CHANCE Events are alcohol-free events; possession or consumption of alcohol at the Event, and arrival under the influence of alcohol or drugs, are prohibited for all attendees regardless of age.

We reserve the right to refuse entry to, or remove from the Event, any person without refund who: is or appears to be under the influence of alcohol or drugs; possesses prohibited items; engages in fighting, harassment, discriminatory conduct, sexual misconduct, theft, or vandalism; engages in dangerous crowd behavior (including crowd surfing, stage diving, or intentional aggressive moshing where prohibited); fails to comply with security or staff instructions; misrepresents their age or identity; or otherwise violates these Terms or venue rules. Where conduct may be unlawful, we may involve law enforcement, and Minors’ parents or guardians may be contacted.

11. Assumption of Risk

Read this section carefully. It affects your legal rights.

Attendance at a live music event involves inherent risks. These include, without limitation: exposure to loud, sustained, high-decibel sound capable of causing temporary or permanent hearing damage; strobe lighting, lasers, and other intense lighting effects capable of triggering photosensitive epileptic seizures or other adverse reactions; fog, haze, and other atmospheric effects; large, dense, and fast-moving crowds, with associated risks of pushing, crushing, trampling, falls, and contact with other attendees; slippery or uneven surfaces; elevated temperatures and risk of dehydration or exhaustion from physical activity such as dancing; exposure to communicable diseases; risks associated with entering and leaving the venue and surrounding areas; and the acts or omissions of other attendees and third parties.

You voluntarily and knowingly assume all such risks, both known and unknown, whether or not listed above, including risks arising from the ordinary negligence of the Released Parties (defined below), as a condition of attending the Event. If you have a medical condition that may be aggravated by any of the above — including photosensitivity, heart conditions, respiratory conditions, or pregnancy — you are responsible for evaluating, with your own medical advisers, whether to attend. Hearing protection is recommended for all attendees.

12. Release and Waiver of Liability

This is a release of legal claims. Read it carefully.

To the maximum extent permitted by Colorado law, you — on behalf of yourself, your heirs, personal representatives, and assigns, and, if you are a parent or legal guardian agreeing on behalf of a Minor pursuant to Section 3.2 and Colorado Revised Statutes § 13-22-107, on behalf of that Minor — hereby release, waive, discharge, and covenant not to sue CHANCE, its owners, operators, principals, affiliates, and their respective officers, directors, employees, contractors, volunteers, performers, agents, successors, and assigns, together with the Event venue and its owners, operators, and staff (collectively, the “Released Parties”), from and for any and all claims, demands, causes of action, damages, losses, and expenses (including attorneys’ fees) for personal injury, illness, death, property damage or loss, or emotional distress arising out of or in connection with attendance at or participation in any Event, including claims arising from the ordinary negligence of any Released Party.

This release does not extend to claims arising from gross negligence, willful or wanton conduct, or intentional misconduct, or to any other claims that cannot lawfully be released under Colorado law, and nothing in these Terms is intended to release any claim that is non-waivable by statute. If you are a Minor whose parent or guardian has not agreed to these Terms, the release in this Section is made by you to the fullest extent permitted by law and by your parent or guardian upon their consent to your attendance.

13. Medical Treatment Authorization

In the event of an injury or medical emergency at an Event, you authorize CHANCE, venue staff, and emergency medical personnel to administer or arrange first aid, emergency treatment, and transport to a medical facility as they reasonably deem necessary, at your cost (or the cost of the Minor’s parent or guardian). If you are a parent or guardian of an attending Minor, you consent to such treatment for the Minor when you cannot be reached in an emergency, and you agree to provide the Minor with a means of contacting you during the Event.

14. Photography, Recording, and Media Release

Events are photographed and recorded. By attending an Event, you irrevocably grant CHANCE and its designees the right to record, photograph, and film your image, likeness, voice, and actions at the Event, and to use, reproduce, edit, publish, distribute, and display such recordings and images, in whole or in part, in any media now known or later developed (including social media and promotional materials), worldwide and in perpetuity, for promotional, marketing, archival, and editorial purposes, without compensation, credit, or further consent. You waive any right to inspect or approve such uses. A parent or guardian consenting to a Minor’s attendance grants this release on the Minor’s behalf. If you do not agree to this release, do not attend the Event.

Personal, non-commercial photography with a phone is permitted unless otherwise posted; all other recording is subject to Section 9.

15. Force Majeure

CHANCE is not liable for any failure or delay in performance, including cancellation, postponement, or modification of an Event, caused by circumstances beyond its reasonable control, including severe weather, natural disaster, fire, epidemic or public health emergency, governmental order or venue closure, utility or infrastructure failure, labor disruption, civil disturbance, terrorism, or artist illness or unavailability. In such circumstances, your sole and exclusive remedy is the refund or rescheduled-Event rights described in Section 5.

16. Event Communications

By purchasing a Ticket, you consent to receive transactional communications about your order and the Event — including order confirmations, Ticket delivery, schedule or venue changes, safety notices, and cancellation or rescheduling notices — at the email address you provide. If you provide a phone number, you additionally consent to receive Event-related calls and text messages at that number for the same operational purposes (message and data rates may apply; reply STOP to opt out of texts). These communications are not marketing and are required to deliver the service you purchased; opting out of them may impair our ability to deliver your Tickets or notify you of material changes.

17. Intellectual Property

All content on the Site — including text, graphics, logos, images, audio, video, software, and the overall design and layout — is the property of CHANCE or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The CHANCE name, logos, event names, and related marks are trademarks of CHANCE; you may not use them without prior written consent. Recordings made at Events by CHANCE or its designees are and remain the sole property of CHANCE.

18. Prohibited Uses of the Site

You agree not to:

• Use automated systems, bots, or scripts to reserve or purchase Tickets, or to circumvent purchase limits, reservation holds, rate limits, or bot-detection measures.
• Reproduce, counterfeit, alter, or tamper with Tickets or QR codes, or scan or attempt to validate a Ticket other than through authorized entry.
• Probe, scan, or test the vulnerability of the Site, interfere with its operation, or access data not intended for you.
• Impersonate another person or misrepresent your affiliation, age, or identity.
• Use the Site for any unlawful purpose or in violation of these Terms.

19. Disclaimer of Warranties

The Site and all Tickets and Events are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any Event will meet your expectations.

20. Limitation of Liability

To the maximum extent permitted by applicable law: (a) in no event will the Released Parties be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Site, any Ticket, or any Event, even if advised of the possibility of such damages; and (b) the total aggregate liability of the Released Parties for all claims arising out of or relating to the Site, any Ticket, or any Event shall not exceed the amount you actually paid for the Ticket(s) giving rise to the claim. The limitations in this Section apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if a limited remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case, liability is limited to the greatest extent permitted by law. Nothing in this Section limits liability that cannot be limited under applicable law, including for gross negligence or willful misconduct.

21. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms or of any law or venue rule; (b) your conduct at an Event, including injury or damage you cause to any person or property; (c) your misuse of the Site or of any Ticket; or (d) if you are a parent or guardian, the attendance and conduct of your Minor at an Event.

22. Governing Law; Venue; Jury and Class Waivers; Time Limit

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms, the Site, a Ticket, or an Event shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to the personal jurisdiction and venue of those courts. Notwithstanding the foregoing, either party may bring an individual claim in small claims court where jurisdictionally proper.

To the extent permitted by law, you and CHANCE each waive the right to a trial by jury and the right to participate in a class action, class arbitration, or other representative proceeding. All claims must be brought in the parties’ individual capacities.

Any claim arising out of or relating to these Terms, a Ticket, or an Event must be filed within one (1) year after the claim accrues, or the shortest longer period required by applicable law; claims filed later are permanently barred.

23. Severability; Entire Agreement; Miscellaneous

If any provision of these Terms is held unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the Privacy Policy and any Event-specific rules posted on the Event page or at the venue, constitute the entire agreement between you and CHANCE regarding the Site, Tickets, and Events, and supersede all prior agreements and understandings. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms except by transferring a Ticket through the official transfer tool (Section 6); we may assign these Terms in connection with a reorganization or transfer of the Events business. Sections 5, 7, and 11 through 23 survive the Event and any termination of these Terms.
